By accessing and/or using this portal/website you must accept this agreement and follow the instructions of registration and adhere to our policies. The legally binding terms that this agreement sets out for your use of any portion/page/service of the portal/website and your membership are stated herein. Any or all of the terms may be changed or modified at any time by The Guitar A-Go-Go/website/portal and will take effect upon posting(s) by us. The Agreement accepted by you includes and incorporates The Guitar A-Go-Go’s acceptable use policies for content posted within this website/portal, or privacy policy, and any content regarding or relating to the website/portal. TERMS OF AGREEMENT 1. In order to use this site as a member or registered service provider (dealer) you must be sixteen (16) years of age or older. Void where prohibited. Also upon using this website/portal, you warrant and represent that you have the rights, authority and capacity to legally enter into this agreement, and you also agree to ALL of the terms and conditions set forth in this agreement. 2. Fees and Services: No fees are charged for search or contact with proprietors/members/dealers regarding inventory for sale/trade/consignment. Fees are charged for advertisements, or for posting items for sale through our web portal. As a member, you have the opportunity to accept or reject these fees upon the sign up process. Subscriptions are available and are incorporated into this agreement by reference(s). The Guitar A-Go-Go may change the subscription policies and/or the fees for our services, and these changes are effective within thirty (30) days of posting such notice(s). The Guitar A-Go-Go reserves the right to offer promotions/comps/changes to our fees at our sole discretion at any time we choose. All fees are quoted in United States dollar amounts. All usage fees payable to The Guitar A-Go-Go are your responsibility and expected immediately. 3. All agreements remain in force and full effect while you use the website/portal. You may terminate your membership at any time, in writing or via email notification within 30 days before your present subscription agreement is to be renewed, to The Guitar A-Go-Go. The Guitar A-Go-Go may terminate your membership for any reason, effective immediately upon our notification to you at the email address you provide (correct or operative email addresses are not our responsibility). All fees are non-refundable. If The Guitar A-Go-Go terminates your subscription without due cause, your membership and advertising remains active until the end date specified in your pre-paid term and renewal will not be allowed. Any breach of any portion of this agreement is grounds for immediate termination and any fees associated will not be refunded for any reason. 4. With the exception of information which is public domain or for any information that you have been given express written permission, all proprietary rights are owned by The Guitar A-Go-Go; you may not modify, transmit, distribute, perform, display or publish such information. 5. You must obtain written consent to post, distribute, or reproduce any copyrighted material or trademarks or any other proprietary information before doing so. 6. The use of this website or service is stated in our privacy statement by joining/member/dealer you acknowledge and agree to comply with the privacy policy of The Guitar A-Go-Go. 7. You, as a free or paying member/user, are solely responsible for your content and interactions while using this site/portal. The Guitar A-Go-Go, Inc. does reserve the rights, but has no obligation to, monitor or act upon any disputes that occur. 8. The Guitar A-Go-Go disclaimer states that we (The Guitar A-Go-Go) are not responsible for any content posted upon/in this website/portal or in connection with any service(s) whatsoever or for any reason. The Guitar A-Go-Go assumes no responsibility for any errors, omissions, interruptions, delays, deletions, or defects in an operational or transmission or communications failure(s), nor for any equipment or programming, loading or posting failures. The Guitar A-Go-Go is not responsible in any way, shape, form or fashion for the conduct of any user or paid member, customer, dealer of this service. The Guitar A-Go-Go is not responsible for any technical malfunction/failure of any kind associated with networks, communications, computer systems, servers, providers of any equipment, software or technical difficulties, failures or problems whatsoever. The Guitar A-Go-Go is not responsible for any injury or damage to users/members or their computer(s), software, misc. that result from using/participating/downloading/uploading any material(s) from any source(s). All services provided in connection with The Guitar A-Go-Go are provided “As Is” and The Guitar A-Go-Go disclaims any warranty of any nature, for any reason of any kind and under no circumstances can The Guitar A-Go-Go be responsible for any payment(s) felt/implied/or due to anyone for any reason whatsoever. The Guitar A-Go-Go shall in no event be liable to any party or person in any case for any indirect, consequential, incidental, special, or exemplary punitive damages, losses, profits, lost or otherwise, from your using the website/portal/service(s). 9. No areas of this site may be downloaded, exported or re-exported into or to a national or resident of any country which the United States of America has embargoed at any time for any reason. 10. All disputes by using this site will be handled/governed solely by The Guitar A-Go-Go. 11. You also agree to indemnify and hold The Guitar A-Go-Go and its subsidiaries, affiliates, officers, agents, partners, parents, and employees harmless from any and all loss, liability, claims, suits, and demands, including any and all fees whatsoever made by any party due to or arising from your use of the services in violation of this or any future agreement or from any breach on your part(s) of this or any form of agreement/representation(s)/warranty(ies) set forth. 12. Usage Policies: The Guitar A-Go-Go has the right(s) to review and/or delete any content whatsoever within this site/portal and sole judgment is the right reserved by The Guitar A-Go-Go. No content that is offensive, illegal or violates anyone’s rights whatsoever may be posted anywhere within this site/portal for any reason whatsoever. As a user you are solely responsible for all content that you publish/post/display anywhere on this site or that you transmit to others. By posting/publishing/displaying any content within The Guitar A-Go-Go you grant automatically The Guitar A-Go-Go an irrevocable, perpetual, non-exclusive and fully paid worldwide license to use, copy, edit, display, perform, air, transmit, record or distribute any and all information and content anywhere in any form and grant or authorize sublicenses and that you warrant you have the right to grant any and all of the above. The Guitar A-Go-Go may investigate and take any action(s) we feel appropriate at our sole discretion against anyone for any reason whatsoever, including termination of contract/services. Removal of content for violations of this agreement may include, but are not limited to, the following reasons: offensive content, harassment, transmission of unsolicited materials, false promotion, conduct that is abusive, threatening, obscene, defamatory or libelous, any illegal or unauthorized activities, any sexual or violent subject matter, or solicitation of personal information from anyone under 16 years of age, providing any information about any illegal activities or distribute any such information. This list is not all-inclusive nor does it encompass all the reasons for termination/investigation, reasonable complaints may also be investigated by The Guitar A-Go-Go at any time against any member/user of The Guitar A-Go-Go site(s). 13. Please remember that this is a professional site/portal and to act accordingly. It is the client’s responsibility to understand disclaimer, posting, return policies, fees and information regarding any and all purchases or entered agreements with any dealer, store, portal, proprietor, service provider or their agent(s). It is the responsibility of the dealers, stores, proprietors and service providers to honestly portray any and all services/wares to their prospective clients. The Guitar A-Go-Go is not, nor can not, be held responsible for any disputes that transpire within its community. 14. All registered trademarks or phrases associated with any product remains solely the registrar’s property and The Guitar A-Go-Go recognizes these as such and in no way, shape or form is associated with, be it indirectly or implied, with these trademarks, registered or otherwise. These phrases or trademarks, if used by The Guitar A-Go-Go clientele are used solely for descriptive purposes only. All information posted within The Guitar A-Go-Go doe not necessarily reflect the view of the owner(s), administrators, employees or family of The Guitar A-Go-Go. No warranties/claims/association is ever implied by The Guitar A-Go-Go with such trademarks, registered or otherwise.
